Purpose: The purpose of this document is to establish the General Conditions of Use and the General Conditions of Sale and returns of the online sales website www.cualiva.com.

Identity of the parties: The general conditions of sale described below (hereinafter General Conditions of Sale), exclusively govern the contractual relations between every user of the website www.cualiva.com (hereinafter referred to as “Client”) and the seller, which is LUIS RUIZ CANO, a company domiciled at C / San Antonio 3, 23686, Mures, Jaén and with NIE 77372318L. Registered in the Group: 0521- SPECIAL REGIME FOR SELF-EMPLOYED OR SELF-EMPLOYED WORKERS.

Placing your order:

  • The client must be of legal age to be able to place an order at www.cualiva.com
  • It is necessary that in the registration you provide us with: mobile or landline telephone, email address, first and last name and full shipping address (with postal code, town, province and country).
  • The means of contact that will be used to send you notifications about your order will be mainly email, although sometimes we can also use the telephone or physical postal address.
  • The conditions of use and purchase of this website are ONLY valid for purchases made in Spain.
  • If the order is accepted, the customer will receive an Order Confirmation by email. This Order Confirmation will be effective from its shipment. If, on the other hand, we cannot accept your Order, we will try to contact the customer by email, telephone or post.

Prices:

  • CUALIVA will send an electronic receipt. This receipt will be issued in the name of the individual or company that has placed the order, so customers should make sure to write the correct name. The product or products will be shipped according to the Shipping Method selected by the customer.
  • Once the purchase is made and as quickly as possible, within reason, and within 24 hours, CUALIVA will send customers an email with the receipt of the order that will contain the summary of the purchase, as well as payment information if proceeds and shipping and billing information.
  • Very occasionally the prices of the products shown on our website, almazaralaalqueria.com, may be specified incorrectly and show a lower or higher price than due. When this happens and, if we have confirmed your order, we will immediately contact the user in order to issue a new order confirmation with the correct price. In the event that the corresponding price is higher, the user may cancel their order and we will refund any amount that has already been paid.
  • There may be occasions when it is impossible for us to supply the ordered products due to lack of stock. In these cases we will contact the customer to inform him of the products available. If you do not accept our suggestions, we will cancel your order in relation to the products that we cannot supply and we will refund the full amount. The return of these sums of money will be the limit of our responsibility towards the user, if it is impossible for us to supply the products.
  • We reserve the right to change our prices at any time. However, we undertake to apply the rates in force indicated on the website, at the time of placing your order.
  • Shipping costs, when applicable, are borne partly by the customer and by CUALIVA, as indicated in the order and invoice.
  • VAT The applicable rate indicated on your invoice is included in the price.
  • The price of the products includes the corresponding VAT and will be the one indicated in your order and / or invoice.

Availability:

  • The availability of the products offered by CUALIVA. Through its web pages it can vary depending on the demand of the clients. Despite the fact that CUALIVA. updates the stock periodically, the product requested by the customer could be out of stock at that time. In this case, CUALIVA will send an e-mail to the client informing him of the impossibility of fulfilling the order.

Supply of your order:

  • The hours of receipt of orders is twenty-four (24) hours three hundred sixty-five (365) days of the year, although orders placed after seventeen (18) hours will not be processed, remaining for the next business day in Mures, Alcalá la Real, Jaén. Orders received over the weekend will be processed first thing the following Monday, or the first business day.
  • The period between placing the order and the date of the first delivery attempt by the transport company at the address indicated in the order corresponds to the sum of these 2 factors:
  • The delivery preparation period (24 to 48 h) = validation and verification of your data and payment + preparation of your order + collection by the transport company.
  • The transport and delivery time of your order will depend on the transport company.
  • These deadlines are indicated in business days.

Payment of your order/s:

All payments will be made in any currency applying the change to euro.

A) Payment by credit / debit card: If you choose to pay by card, your order cannot be taken into account and will not be processed until the payment has been authorized by your bank or savings bank. Online payment by credit card is made through the “Redsys” security system, which encrypts your bank details when they are transmitted over the internet.
For security reasons, CUALIVA verifies all orders paid by bank card.

B) Through BIZUM: If you pay through bizum, a payment confirmation will be sent to you in the form of a text message. Your order will not be reserved or shipped until payment has been received by us in our bank account.

Delivery of your order:

The order will be sent to the address you indicated at the time you made your purchase.

You can cancel your order at any time before sending it by sending an email to cualiva@gmail.com indicating your order number.

Deliveries are made in the fastest possible time.

Defective item:

  • If the item you have received is defective, contact 613 005 165 specifying your order number, your name and address, the product details and the reason for the return, as well as if you request a refund or an exchange. Later, we will tell you how to proceed with the return. You have 30 from receipt of the defective item to return it to us.
  • At the time of delivery, you must carefully verify the state in which the merchandise is delivered and the number of packages delivered as indicated on the carrier’s delivery note. In case of errors in the delivery received or that it is visibly damaged, it is important that it be reflected on the delivery note of the carrier and inform these facts to CUALIVA within 24 hours and in writing via email to cualiva @ gmail.com or by any other means.

Receiving the wrong item:

  • If the item you have received is not the one you originally requested, contact 613 005 165 specifying your order number, your name and address, the product details and the reason for the return, as well as if you request a refund or a change. Later, we will tell you how to proceed with the return.
  • CUALIVA will bear the costs of collecting the wrong product and delivering the one corresponding to the order placed.

Cualiva won’t accept returns of:

  • Products with the opening seal or packaging open or damaged.
  • Products that show improper handling or cleaning.
  • Shipping costs, insurance and any damage that may occur during transport will be borne by the Customer.
  • The receipt of the product will not imply the acceptance or conformity of the return, so that CUALIVA may enjoy a period of seven (7) days to reveal to the Client any disagreement that may arise. In addition, it reserves the right to apply a penalty to the value of the initial refund in the event that the product does not arrive in perfect condition.

Request cancellations:

According to the Distance Shipping Regulations, you have the right to cancel the order of any item purchased at CUALIVA with a full refund.

Cancellation requests must be made in writing to cualiva@gmail.com, specifying your order number, within a period between 7 and 14 working days following receipt of the items.

Return or exchange an item:

  • If you are not completely satisfied with your purchase, simply return the item (s) to us in their original condition within 14 days of receipt.
  • We will send a refund receipt, or exchange the item for another if you prefer. However, shipping costs are only refunded if you have canceled the entire order within 7 days or if the items are faulty and a refund has been made.
  • The reimbursement of the amounts paid will be made through the means of payment used in the purchase.

Keep in mind:

  • The article is the responsibility of the user until it reaches us. For your own protection, we recommend that you send the package through a shipping service that insures you for the value of the objects.

If the error occurs in some of the prices shown and a customer has made a purchase, we will notify him of this error and the customer or user will have the right to cancel his order at no cost on his part. Sending an automatic purchase confirmation does not validate the conditions of an erroneous price.
